Privacy policy
Privacy Policy
Your trust matters as much to us as the leather we work with. This policy explains, in plain language, what personal information Valmere collects when you visit valmereandco.com, why we collect it, who we share it with, and the choices you have — wherever in the world you are.
Valmere is a brand operated by AFS Digital LLC, a limited liability company registered in Florida, United States (“Valmere”, “we”, “us”). We operate this store and website, together with all related content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use and disclose your personal information when you visit or use the Services, make a purchase or other transaction, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy governs the collection, processing and disclosure of your personal information.
Please read this Privacy Policy carefully. By using or accessing any of the Services, you acknowledge that you have read it and understand how your information is collected, used and disclosed as described here.
01Personal information we collect
“Personal information” means information that identifies you or can reasonably be linked to you or another person. It does not include information that is collected anonymously or that has been de-identified so that it can no longer be linked to you. Depending on how you interact with the Services, where you live and what applicable law permits or requires, we may collect or process the following categories of personal information, including inferences drawn from it:
| Category | Examples |
|---|---|
| Contact details | Name, billing and shipping address, phone number, email address. |
| Payment information | Payment card details, payment method, transaction details and payment confirmations. Full card numbers are handled by our payment processors and are never stored on our servers. |
| Account information | Username, password, preferences and settings, if you create an account. |
| Transaction information | Items you view, add to your cart or wishlist, purchase, return, exchange or cancel, and your order history. |
| Communications | The content of messages you send us, for example a customer-support enquiry or a product review. |
| Device information | Device type, browser, operating system, network connection, IP address and other unique identifiers. |
| Usage information | How and when you interact with or navigate the Services, including pages viewed and links clicked. |
02Where the information comes from
- Directly from you — when you create an account, place an order, subscribe to our emails, communicate with us, or otherwise provide your personal information.
- Automatically through the Services — from your device when you visit our website or use our products, including through cookies and similar technologies (see section 04).
- From our service providers — when we engage them to enable certain technology, or when they collect or process personal information on our behalf.
- From our partners or other third parties — for example advertising platforms, payment providers and shipping carriers.
03How we use your personal information
- Providing, tailoring and improving the Services. To perform our contract with you: process payments, fulfil and ship orders, handle returns and exchanges, manage your account, remember your preferences and the items you are interested in, send notifications about your orders, enable you to post reviews, and create a personalised shopping experience, such as recommending products related to your purchases.
- Marketing and advertising. To send marketing and promotional communications by email, text message or post, and to show you online advertisements for our products on the Services or on other websites, including based on items you have previously viewed, purchased or added to your cart.
- Security and fraud prevention. To authenticate your account, provide a secure payment and shopping experience, and detect, investigate or act on possible fraudulent, illegal, unsafe or malicious activity. If you register an account, you are responsible for keeping your credentials safe; please do not share your username, password or other access details with anyone.
- Communicating with you. To provide customer support, respond to your requests, and maintain our business relationship with you.
- Legal reasons. To comply with applicable law or valid legal process, including requests from law-enforcement or government agencies; to investigate or take part in civil discovery, litigation or other legal proceedings; and to enforce or investigate potential violations of our terms or policies.
Legal bases (EEA, UK, Switzerland and similar jurisdictions)
Where required by law, we process your personal information on the following legal bases: performance of a contract (processing your order and providing the Services); our legitimate interests (improving and securing the Services, preventing fraud, and marketing to existing customers where permitted); your consent (for example, for non-essential cookies and certain marketing communications, which you may withdraw at any time); and compliance with legal obligations (such as tax and accounting rules).
04Cookies and similar technologies
Like most online stores, we use cookies, pixels and similar technologies to keep the Services running (for example, remembering your cart and login), to understand how the Services are used, and to support advertising. Some cookies are set by Shopify and are necessary for the store to work; others are set by analytics and advertising partners.
You can control cookies through your browser settings, and, where required by law, through the cookie banner shown when you first visit the site. Blocking essential cookies may prevent parts of the Services from working properly. For more detail on the cookies Shopify uses, see the Shopify Cookie Policy.
05How we disclose personal information
We may disclose your personal information to third parties for legitimate purposes, subject to this Privacy Policy, including:
- With Shopify, vendors and other service providers who perform services on our behalf, such as hosting, IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping.
- With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalised advertising with third-party services based on your online activity across different merchants and websites. These partners use your information in accordance with their own privacy notices. Depending on where you live, you may have the right to direct us not to share your information for targeted advertising; you can exercise that right here.
- When you direct or consent to it — for example, sharing your address with a carrier to deliver your order, or through your use of social-media widgets or login integrations.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger, sale of assets or bankruptcy; to comply with legal obligations (including subpoenas, search warrants and similar requests); to enforce our terms and policies; and to protect or defend the Services, our rights, and the rights of our users or others.
We do not sell your personal information for money.
06Our relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and with third parties that may be located in countries other than where you live.
To help protect, grow and improve our business, we also use certain Shopify enhanced features that draw on data from your interactions with our store, with other merchants and with Shopify. For these features, Shopify is responsible for processing your personal information, including responding to your requests to exercise your rights in relation to that use. To learn more, see the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights directly through the Shopify Privacy Portal.
07Third-party websites and links
The Services may link to websites or platforms operated by third parties. If you follow such links, please review their privacy and security policies and terms. We do not guarantee, and are not responsible for, the privacy or security of those sites, or the accuracy, completeness or reliability of information found on them. Information you share in public or semi-public places, including third-party social networks, may be viewable by other users of the Services or of those platforms. A link does not, by itself, imply our endorsement of the content or of its owners or operators, except as stated on the Services.
08Children’s data
The Services are not intended for children, and we do not knowingly collect personal information from anyone under the age of majority in their jurisdiction. If you are the parent or guardian of a child who has provided us with personal information, please contact us using the details below and we will delete it. As of the date of this Privacy Policy, we have no actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) the personal information of anyone under 16.
09Security and retention
We use technical and organisational measures appropriate to the risk to protect your personal information, and payments are processed through PCI-DSS-compliant providers. No security measure is perfect, however, and we cannot guarantee “perfect security”; information sent to us may not be secure while in transit. Please avoid using unsecured channels to send us sensitive or confidential information.
We keep personal information only for as long as needed for the purposes described in this policy. In practice this means: order and transaction records for as long as required by tax and accounting law (typically 5–10 years, depending on the country); account information for as long as your account is active and for a reasonable period afterwards; marketing data until you unsubscribe or withdraw consent; and support communications for as long as necessary to resolve your enquiry and maintain a record of it. We may retain information longer where necessary to resolve disputes or enforce our agreements.
10Your rights and choices
Depending on where you live, you may have some or all of the rights below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.
- Access / know — request access to the personal information we hold about you.
- Deletion — request that we delete personal information we maintain about you.
- Correction — request that we correct inaccurate personal information.
- Portability — receive a copy of your personal information and, in certain circumstances, ask us to transfer it to a third party.
- Opt out of sale, sharing or targeted advertising — depending on where you live, opt out of the “sale” or “sharing” of your personal information, or of its processing for “targeted advertising” as defined in applicable privacy laws. You can exercise this right here. If you visit our website with the Global Privacy Control signal enabled, we will, where applicable, treat this as an opt-out request for that browser and device, and for your Shopify account if we can associate it. We do not respond to other “Do Not Track” signals.
- Managing communications — you may unsubscribe from promotional emails at any time using the link in each email, and from text messages by replying STOP. We may still send you non-promotional messages about your account or orders.
Additional rights in the EEA, UK and Switzerland
- Objection and restriction — you may ask us to stop or restrict processing of your personal information for certain purposes, including direct marketing.
- Withdrawal of consent — where we rely on consent, you may withdraw it at any time; this does not affect the lawfulness of processing carried out before withdrawal.
Residents of California and other U.S. states
You may have the rights listed above under laws such as the California Consumer Privacy Act (CCPA/CPRA) and similar state laws, including the right to know the categories of information we collect and disclose, and the right not to be discriminated against for exercising your rights.
Residents of Brazil
If you are in Brazil, you have the rights provided by the Lei Geral de Proteção de Dados (LGPD), including confirmation of processing, access, correction, anonymisation, portability, deletion, and information about the entities with which we have shared your data.
How to exercise your rights
You may exercise any of these rights where indicated on the Services or by contacting us using the details below. We will not discriminate against you for exercising your rights. We may need to verify your identity before processing a request, as permitted or required by law. You may designate an authorised agent to make a request on your behalf; we will require proof of authorisation and may need to verify your identity directly. We respond to requests within the timeframes required by applicable law (generally within 30–45 days).
11Complaints
If you have a complaint about how we process your personal information, please contact us first using the details below — we will do our best to resolve it. Depending on where you live, you may also have the right to appeal our decision, or to lodge a complaint with your local data protection authority. In the EEA, a list of supervisory authorities is available here; in the UK, the authority is the Information Commissioner’s Office; in Brazil, the ANPD.
12International transfers
We serve customers worldwide and may transfer, store and process your personal information outside the country you live in, including in the United States, Canada and the countries where our service providers operate.
When we transfer personal information out of the European Economic Area, the United Kingdom or Switzerland, we rely on recognised transfer mechanisms such as the European Commission’s Standard Contractual Clauses (or the equivalent UK and Swiss instruments), unless the destination country has been recognised as providing an adequate level of protection.
13Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for operational, legal or regulatory reasons. We will post the revised policy on this website, update the “Last updated” date, and give you notice where required by law.
